1. The agreement
These terms are between you and Captur Labs Limited ("capturGO", "we", "us"). They apply to the capturGO application, the website at capturgo.com, and any related service. By creating an account or submitting a recording, you accept them. If you do not accept them, do not use the service.
Our Privacy Policy forms part of this agreement. Read it before you record, because it explains what happens to your footage.
2. Eligibility
- You must be at least 18 years old.
- You must be legally able to enter into this agreement where you live.
- You must not be subject to sanctions that would make it unlawful for us to pay you.
- One account per person. Accounts are personal and may not be transferred or shared.
3. Your account
Keep your login details secure, and keep your payout details accurate. You are responsible for activity under your account. Tell us promptly if you believe it has been compromised.
4. Capture tasks
Tasks are published in the app with a description, instructions, a minimum and maximum clip length, device requirements, and acceptance criteria. Availability varies by device and region, and we may add, change or withdraw tasks at any time.
Some tasks require sensor or camera capabilities your phone may not have. Where your device does not meet a task's requirements, the app will tell you and recording will be unavailable.
Nothing in these terms guarantees that any particular task, quantity of tasks, or level of earnings will be available to you.
5. Recording rules
When you record a task, you agree that:
- You have the right to record where you are. You own the space, or you have permission from whoever does. Do not record in a workplace without your employer's consent, and do not record anywhere you are not allowed to film.
- No other people. Do not record other people. Check your frame before you start. If someone enters the shot, stop and start again.
- No identifiable faces. Clips in which a face can be identified are rejected and deleted. See the Privacy Policy for how this works.
- Nothing confidential. Do not record documents, screens, badges, licence plates or anything else carrying personal or confidential information.
- Genuine work. Record the task as described, at a natural pace. Do not stage, fake, loop or re-use footage.
- Your own footage. You recorded it yourself, on your own device, and you have the right to give us the licence in section 7.
- Safety first. Do not record while driving, operating dangerous machinery, or anywhere recording would put you or anyone else at risk. You are responsible for your own safety.
6. Review and acceptance
Every submission goes through automated checks and human review against the task's acceptance criteria. We may accept a clip, reject it, or ask you to re-record.
A clip may be rejected for reasons including insufficient quality, wrong framing, missing or incomplete sensor data, a visible face or other person, a clip that is too short, or a task that was not performed as described.
Rejected clips earn nothing and are deleted. Our review decision is final, although you may query it by contacting us.
7. Ownership and licence
You keep ownership of your recordings. By submitting one, you grant Captur Labs Limited a worldwide, perpetual, irrevocable, transferable, sub-licensable, royalty-free licence to store, reproduce, modify, annotate, combine with other data, and license the recording and anything derived from it, for any purpose, including training and evaluating artificial intelligence and robotics systems.
This licence lets us sell datasets containing your accepted clips to our customers. It is what we pay you for.
The licence applies to accepted clips. Rejected clips are deleted, and the licence over them ends on deletion.
The licence survives the closure of your account. We can remove your recordings from our systems and from future datasets on request, but a dataset already delivered to a customer cannot be recalled.
You confirm that you have all rights necessary to grant this licence, and that your recordings do not infringe anyone else's rights.
8. Rewards and payment
- You are paid for accepted clips only. The rate for each task is shown in the app before you record.
- Payments are calculated after review and are normally made within two weeks of acceptance.
- Payments are made in the currency and to the payout method shown in your account. Rates and methods may change; changes apply to tasks started after the change.
- You are responsible for any taxes you owe on what you earn. We are not your employer, and this agreement does not create employment, partnership or agency.
- We may withhold or reverse payment where we reasonably believe a submission is fraudulent, duplicated, staged, or otherwise breaches these terms.
9. Prohibited conduct
- Submitting footage you did not record, or that you have submitted before.
- Using multiple accounts, automation or any other means to inflate rewards.
- Interfering with the app, our infrastructure, or the review process.
- Recording unlawfully, or in breach of another person's privacy.
- Reverse engineering the app except to the extent the law permits.
10. Our intellectual property
The capturGO app, website, branding, task taxonomy, acceptance criteria and documentation belong to Captur Labs Limited. You get a limited, revocable, non-transferable licence to use the app for its intended purpose, and nothing more.
11. Suspension and termination
You may close your account at any time through the account deletion page. We may suspend or terminate your account if you breach these terms, if we are required to by law, or if we discontinue the service. Where we terminate for reasons other than your breach, we will pay for clips already accepted.
Sections 7, 8, 12, 13 and 15 survive termination.
12. Disclaimers
The service is provided "as is". To the extent the law allows, we exclude all implied warranties. We do not warrant that the app will be uninterrupted or error-free, that any task will be available to you, or that any submission will be accepted.
13. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, or loss of anticipated earnings, and our total liability to you is limited to the greater of the amounts we paid you in the twelve months before the claim, or USD 100.
14. Changes
We may update these terms. Changes are posted here with a new date, and material changes are notified in the app. Continuing to use the service after a change means you accept it.
15. Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction over any dispute. This does not remove any mandatory consumer protection you have under the law of the country where you live.
